What Is a DWI/DUI?
It is a crime in the state of Minnesota to drive, operate, or be in physical control of any motor vehicle anywhere in the state of Minnesota while under the influence of alcohol, a controlled substance, or knowingly under the influence of a hazardous substance or any combination of these, an alcohol concentration of .08 or more at the time, or within two hours of driving, operating or being in control of a motor vehicle, or having any amount or the metabolites of a schedule I or II controlled substance (other than marijuana) in the body. It is also a crime to refuse to submit to a chemical test of the person’s blood, breath or urine under Minnesota’s Implied Consent law. A person can also be arrested for DWI/DUI operating an off-road recreational vehicle or a motorboat while under the influence as well, if he or she is driving, operating or in physical control of an off-road recreational vehicle or motorized watercraft while under the influence of drugs or alcohol.
