A DUN letter is sent from a person or their attorney/representative to a third party billing company or the company pursing the matter, in regards to an outstanding upaid bill(s) pertaining to the lawsuit. The DUN letter puts the third party billing company or the company on notice that if they take any action whatsoever in regards to the person’s (they are billing) credit status, or continue to dun for the bill, they will file immediate legal action on their behalf. The DUN Letter is not considered to be an idle threat. There are two legal cases (Bell v. Samaritan Medical Clinic and WCAB v. Small Claims Court) which the company should be aware of, that their recourse is to file a lien and submit teir billing directly to the insurance company/adjuster.
