What is a Direct Consent Adoption?
In a direct consent adoption, birth parents place the child directly with the parents they have chosen as long as the prospective adoptive parents have completed a pre-placement assessment and have been approved by a licensed agency. If the placement is made prior to the birth parents’ appearance in court to consent to the adoption, it is considered a temporary placement. In order for the adoption to occur, the birth parents must appear in court and consent to the adoption be the chosen adoptive parents. The placement is the considered a formal placement. By consenting to the adoption, the birth parents surrender (terminate) their legal rights to the child. The adoption begins at this point.
