What is a conditional use permit?
A Conditional Use Permit (or CUP) reviews certain types of businesses for impacts on the surrounding neighborhood. A CUP generally stipulates conditions for the business operation such as hours, noise control, parking, walls and landscaping as “conditional” approval of the business. A few examples of businesses that need a CUP are: restaurants, bars, automotive sales and repair, dance and martial arts studios, and liquor stores. An application, including a business description and plans, needs to be submitted to the Planning Department for consideration by the City’s Planning Commission a few months prior to approval. Contact the Planning Department at 310-318-0637 or http://www.redondo.org/depts/planning/default.asp for more details.
A CONDITIONAL USE PERMIT (CUP) allows a city or county to consider special uses which may be essential or desirable to a particular community, but which are not allowed as a matter of right within a zoning district, through a public hearing process. A conditional use permit can provide flexibility within a zoning ordinance. Another traditional purpose of the conditional use permit is to enable a municipality to control certain uses which could have detrimental effects on the community (Neighborhood Action Group v. A CUP application tendered by a project proponent is considered at a public hearing and, if approved, is generally subject to a number of pertinent conditions of approval. Depending on local ordinance requirements, hearings are typically held by a board of zoning, the planning commission, or a zoning administrator. The owners of property near the site are sent advance notice of the
A conditional use permit is required for certain uses that have unusual characteristics or impacts. The City Council has designated certain conditional uses in each zone that require this specific review by Planning Commission. Conditional uses require special individual consideration as to their location and compatibility with other uses. Special conditions are applied to conditional use permits to ensure compatibility and to aid in eliminating negative affects caused by the use. Zones are used to separate incompatible land uses and to help achieve uniform development. Conditional use permits may be granted only for uses listed as conditional uses in the various zones set forth in the Zoning Ordinance, or for uses listed requiring conditional use permits in other parts of the zoning ordinance. For example, residential zones, churches, parking lots and day-care centers require a conditional use permit. In commercial zones, a business that requires a liquor license for the sale of alcoh
