It is burglary where the breaking and entering is achieved by threat as opposed to physical invasion. For example, if your door is open and I walk in to commit a felony, I did not commit burglary because there was no breaking. However, if I open up your door and walk into your house with the intent to commit a felony, I did commit burglary. Burglary by threat is a hybrid created by the courts. If I walk into your house to commit a felony and the door is open, but the only reason it is open is because I made threat (e.g. open the door or I am going to shot up your house), then the law will still call this burglary even though the breaking element is not met.
