The Federal Highway Administration (FHWA) issued Worker Visibility as a final rule on Nov. 24, 2006 in 23 CFR Part 634. This final rule became effective Nov. 24, 2008. It requires the use of high-visibility safety apparel for workers within the rights-of-way of federal-aided highways. The FHWA took this action to decrease the likelihood of fatalities or injuries to workers within these zones who are exposed either to traffic (vehicles using the highway for purposes of travel) or to construction vehicle equipment.
