What information is exempt from disclosure under the law?
With the exception of section 9-335, relating to law enforcement records, most exemptions from disclosure in the public records law are contained in the numerous exemptions in Idaho Code sections 9-340A through 9-340H. Even if an exemption applies to a record, according to section 9-338(10), the law does not prevent the disclosure of statistical information that identifies a particular person, unless such disclosure is otherwise prohibited by law. It must be noted that nothing in the law limits the availability of documents and records for discovery in the normal course of judicial or administrative adjudicatory proceedings, subject to the law and rules of evidence and of discovery governing such proceedings.
