What if we receive a child through an agency and the child later develops a serious medical or psychiatric condition that we were not aware of?
Adoption agencies must provide you with all non-identifying medical information that they reasonably can obtain. If you have told the agency you can not accommodate a particular condition, and the agency knowingly or negligently places a child with that condition with you without telling you, then the agency may be liable for any damages the placement has caused. Your best chance of avoiding this is to be sure that you have complete confidence in any agency you work with, and to take the initiative to research any conditions which are of concern in your placement.
