There are very few drivers who may claim an exemption from a speeding offence. Very often drivers appeal against offences but often these claims have no legal standing. When you receive the Notice of Intended Prosecution you must identify who was driving the vehicle at the time. If you then wish to appeal the speeding offence you must allow it to proceed to the Procurator Fiscal. If you believe there are mitigating circumstances it is your responsibility to provide proof of this. This information is then passed to the Procurator Fiscal for decision.
