What if the tenant is holding rent due to a dispute?
Once arrears of rent have reached 8 weeks then it is mandatory to make payments to the landlord provided that there is no finding that the landlord is not a ‘fit and proper person’ or it is not in the customers interests to make direct payments. This can include when the tenant is in dispute with the landlord but evidence must be provided of this.
