Parties are encouraged to negotiate towards a settlement. If you and the Field Administrator’s office are able to reach a settlement regarding the amount of the civil penalty to be paid, the time to pay the settlement, and any other terms, a written agreement should be signed by both you and the Field Administrator. The agreement must contain the statutory basis for the claim, a brief statement of the violation, the date, time and place of payment, and a statement that the agreement is not binding until it is signed by the Field Administrator. Settlement agreements may contain agreed conditions and actions to redress the violations cited in the NOC. If you agree to a settlement before the NOC is being considered by the Assistant Administrator or the ALJ, no additional approval of the agreement is required.
