What if the Order of Protection is wrongfully issued?
The only remedy for a wrongfully issued order of protection is to insist upon one’s right to an evidentiary hearing. Sometimes, unscrupulous spouses will obtain orders of protection without notice based on false allegations as an expedient way to get their spouses thrown out of the house. In such cases, it is imperative to demand a hearing, prove the falsity of the allegations, and have the order vacated.
