What if the non-custodial parent refuses to pay their child support?

The simplest way the Prosecutor’s Office can collect your child support is through income withholding. If the non-custodial parent is 30 days or more behind in paying their child support, we can send an order to their place of employment asking that a certain amount of money be deducted from their paycheck. The non-custodial parent may be called into court if they have not responded to requests to voluntarily pay their child support and income withholding is not an option (i.e. they have no permanent place of employment). A court date may be set. if you have a pending court date, we will take no further action on your case until after the court hearing.
