What if the employee has multiple Orders/Notices to Withhold from different child support agencies and the employee does not earn enough to honor them all?
Priority of withholdings should follow in this order: 1. Current Child/Family Support 2. Medical Support 3. Current Spousal Support 4. Child/Family Support Arrears 5. Spousal Support Arrears 6. Costs and Fees When there are multiple orders for the same employee, determine the Maximum Support Deduction (MSD). If the employee’s principal place of employment is California then the MSD is 50% of Net Disposable Income (For a list of other states’ withholding limits, click here.) Prorate the payment among all the current child support orders. Apply any remainder to assignment for arrearage support for all orders.
