What if I’m still not satisfied with the plans decision?
If you are dissatisfied with the plan’s decision on an appeal, you may request an independent review. If you still are not satisfied, in some cases you may sue the health plan for damages. However, this depends upon the type of coverage you have. Generally, if you are covered by an individual health plan, you can sue under Washington state law. If you are covered by a group employee benefit plan, these are often subject to other laws that restrict your ability to sue.
