Under Chapter 34.05 RCW, Administrative Procedures Act, entities can appeal Ecology penalties to the Pollution Control Hearings Board (PCHB). If either party does not agree with the PCHB decision, they can appeal the decision to the superior court in the county where the violation took place or in Thurston County.
