What has to be observed, if an arbitral award made in China shall be enforced in Europe?
To obtain enforcement of an arbitral award made in China against an European debtor, the arbitral award must first be recognized and declared enforceable. China as well as most European countries has joined the “United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards” (New York Convention) 10th June 1958. The (Chinese) Party, who wants to apply for recognition and enforcement of an arbitral award made in China, shall submit a duly authorized original award or a duly certified copy thereof and the original arbitration agreement or a certified copy thereof together with the application for recognition and enforcement. The arbitral awards and arbitration agreements in Chinese shall be translated into an official language of the country, in which the award is relied upon.
