In Canada, everyone files their own tax return. No such thing as filing together. If you have lived together for at least a year as of December 31, 2007, then you can file as living common law on each of your returns (which he likely did). He probably claimed a credit called the “spousal amount”. Generally he can claim this if your income is below the basic exemption. He may have received a refund without your return having been filed but if you don’t file a return, it is very likely he will get a letter from CRA asking to verify your net income. You should file a tax return even if you don’t owe so that you stay on the government’s radar in case you need to apply for any kind of government program. I think you can only file jointly if you are married. I think what he did was illegal. I would file your taxes if I were you. The IRS will come after you if you don’t file.Plus, everyone that files their taxes are getting a stimulis check from the goverenment. It’s supposed to be $600 for singles, and $1200 for married people.
You need to file your return even though it’s late!! Depending on how much money you made last year, you will probably get a refund and it might be more than any penalties you owe. You don’t want to start your life off being red-flagged by the IRS. His financial issues aren’t your problem. You do what you have to do for YOU!!
