What happens to the clinic staff that does not meet the requirements of the social work licensing law? Does OMH have a plan to assist clinics with this transition?
The Governor is proposing legislation to extend for four years the current exemption for State operated, licensed or funded programs for the Social Work scope of practice provisions which would otherwise expire 1/1/10. OMHs clinic restructuring, with some transition allowance, will require by regulation all psychotherapeutic procedures to be delivered by specified licensed professionals. OMH regulations will, however, be more flexible than the Education Law would, if the extension is not approved, permit. If the temporary exemption is not legislatively extended or made permanent, providers will need to comply with the statutory requirements as of 1/1/10.
