What happens to General Contractors who have abused the M/WBE program?
Article 15A has an enforcement mechanism in place through ESDC. However, as a compromise, DASNY has established a training and development fund where contractors who do not make a “Good Faith Effort” and are non-compliant with the requirements of Article 15A of the Executive Law contribute to the fund. The training fund is utilized for M/WBE seminars and workshops in Construction, A/E and Procurement.
