The $5,000 deposit or Bidders’ Club fee is forfeited in its entirety. The winning bidder’s rights to purchase the aircraft are terminated. The winning bidder’s ability to participate in future online auctions is revoked. Eclipse Aviation reserves the right to offer the aircraft to the next highest bidder or to re-auction the aircraft.
