Immediately after EscrowCard has confirmed that a Seller has filed for bankruptcy, EscrowCard will, irrespective of the Delivery-By-Date, credit the Deposit of all affected Transactions to the respective Buyers. In cases where a Seller is under investigation of, or is charged by a government authority of fraud, the Seller has ceased to operate, and/or the expectation that the Seller will be able to deliver have been significantly affected, EscrowCard after attempting to communicate with the Seller, may at its own discretion, and irrespective of the Delivery-By-Date, credit the Deposit on all affected Transactions to the respective Buyers, place a Hold Payment on all the affected Transactions, and/or attempt to notify affected Buyers.
