What happens if the new governor repeals the tax increase?
Well, as a matter of law, he CAN’T “repeal” it! The enactment on which it is supposedly based was unlawful, unconstitutional, and it is therefore null and void from the beginning – it does not exist, there’s nothing lawful to repeal! As a practical matter of course, the decision to raise the tax must be revoked. But the current governor won’t do it. His actions have set up the bureaucratic engine that is creating the current financial nightmare. Any number of replacement candidates have promised to do it, but it still depends on which one wins if the recall fails, and then on how he feels at the time.
