What happens if the mortgage is not effected by a registered document and not attested by at least two witnesses?
If there is non-compliance of the above mentioned provisions and if the mortgage has not been executed by delivery of title deeds the mortgagee nevertheless acquires the status of a mortgagee by prescription. It must be mentioned that it is the duty of the mortgagee to ensure that a proper title deed is executed in his favour.
