What happens if the LEA does not oppose the appeal?
The LEA may decide that it does not oppose the appeal. If at any stage in the process the LEA decides that it no longer opposes the appeal it will need to write to us to tell us that it has decided to concede the appeal. If the LEA concedes it means that it must act as if the appeal has been decided in the favour of the parents. This covers appeals about refusal to assess, making a statement or the school named in part 4 of the statement. If the appeal is about parts 2 and 3 of the statement and the LEA concedes, this also means that the LEA must act as if the appeal has been decided in the favour of the parents but it is also up to the parents to decide if they want to withdraw the appeal or continue with it. If the parents decide to continue, the LEA will not be able to take further part in the process.
