What happens if the authorised psychiatrist does not examine a person subject to an ITO within 24 hours?
A. All reasonable steps should be taken to ensure the authorised psychiatrist does examine a person subject to an ITO within 24 hours. If a practitioner makes an ITO in the community, part of the decision-making process should be to consider how and where the authorised psychiatrist will conduct the examination. If the authorised psychiatrist does not examine the person within 24 hours, the person’s legal status becomes unclear. In these circumstances a new Request and Recommendation should be completed.
