Employment of a work permit holder is on condition of continued permission to remain in the UK. If Leave to Remain in the UK has expired the person must stop work and their pay will be suspended. Please inform HR Consultancy as soon as possible. Under Section 8 of the Asylum and Immigration Act 1996, from 27 January 1997, it became a criminal offence to employ a person aged 16 or over who is subject to immigration control unless: • that person has current and valid permission to be in the United Kingdom and that permission does not prevent him or her from taking the job in question; or • the person comes into a category where such employment is otherwise allowed (see Does my postholder need a work permit?). (If an FLR(IED) application has been submitted to Work Permits (UK) prior to the expiry date of Leave to Remain in the UK, the person may continue to work.
