What happens if mediation is terminated?
If the complainant asks the mediator to terminate a mediation process under the Horticulture Code the mediator must terminate the mediation. If the respondent asks the mediator to terminate a mediation process under the Horticulture Code, the mediator must do so, provided that: • at least 30 days have passed since the start of the mediation • the dispute has not been resolved. A mediator may also terminate a mediation process at any time if they believe the dispute is unlikely to be resolved. If a mediation is terminated, the mediator must issue a certificate to the mediation adviser as well as to the parties to the dispute, which states: • the names of the parties • the nature of the dispute • that the mediation is finished • that the dispute has not been resolved.
