What happens if I’m not successful in having the default judgment set aside?

If the court confirms the default judgment the judgment creditor has the right to continue to enforce the judgment. There is no limit on the number of times you can apply to set aside the default judgment. However, it would only be worth making another application to set aside the judgment if you had new information or evidence to support your application. You also risk having costs orders made against you. To stop enforcement action by the judgment creditor, you can make an application to pay the debt by instalments. For more information, see Payment by instalments – debtor.
