If the failure to comply with the conflict of interest policy has biased the design, conduct or reporting of the funded research, the DFCI must promptly notify the awarding component of the corrective action taken or to be taken. The awarding component will consider the situation and, as necessary, take appropriate action, or refer the matter to the DFCI for further action, which may include directions to the DFCI on how to maintain appropriate objectivity in the funded project. In addition, the Department of Health and Human Services may at any time inquire into the DFCI procedures and actions regarding conflicting financial interest in PHS-funded research. In turn, the HMS and DFCI response to a deliberate breach of policy will be adjudicated in accordance with applicable disciplinary policies and procedures of the DFCI.
