Actually you don’t necessarily automatically win if the Officer does not show. I am only required to show up if I am subpoenaed. I have court cases scheduled all month for first appearances and sentencing but I am not required to be there for those. I only have to come for trials. Officers may also be excused from court for training, being sick, or if they are on vacation. If you both miss it will be up to the judge to decide. If the Officer has a reason for not being there and you don’t then you could have an Order for Arrest issued for you and your license could be revoked. if both of you were suppose to be there and the Officer does not have a valid reason for missing the case could be dismissed and you could be in the clear. it all depends on the situation and the judge.
