It depends on the state, but yes, in some states even if the woman has an affair, the husband is legally held responsible for the child if she becomes pregnant from the affair. I know this for sure in the state of Texas, I worked there in the NICU and there was a couple that actually had a surrogate carry their twins and when the babies were born prematurely, it was the surrogate and her husband who had legal rights to make medical decisions for the children until a lawyer stepped in to draw up “adoption” papers. Okay people…it’s a man asking the question, so stop telling “her that her husband will do this or that”. Trust me it’s true in some states. You might want to see if you can talk to a lawyer.
Well, you fill out the certificate, so whomever you put down is the father on paper. However, either man could challenge that and have a paternity test done, so it’s best to have it done correctly the first time, or you’ll look like an idiot in the eyes of the court and that could bring you more problems down the road.
No thats not true. You can request that a paternity test be done as soon as the baby is born to find out who the father is. But until the results of the paternity test comes back, no man will be able to sign the birth certificate. I know what youre talking about though, I think I heard something like that before too, but it was a few years back. Rules have changed now. If youre really unsure call the hospital where you’ll be delivering at and speak with the person who handles the birth records.
