Answer 3: If, for example, the couple has an A/B Trust, but no longer needs it because of the increased exemption or if the phase out of the estate tax is made permanent (see answer one), the Decedent’s Trust will still become irrevocable at the first spouse to die’s death and the surviving spouse’s rights in that trust will still be limited even though the reason for creating these limitations may no longer exist.
