What happens after a co-decision-making, guardianship or trusteeship application is made?
There is a new process for making applications for guardianship, trusteeship, and co-decision-making order. Review Officers (OPG) will screen prospective guardians, trustees, or co-decision-makers for suitability, review guardianship and trusteeship plans (with assistance from the Office of the Public Trustee (OPT) for trusteeship plans), they will meet with or interview the adult to explain their rights and determine their views and wishes. The report of the Review Officer will form part of the application documentation. There will be new criteria for the court to consider before granting a guardianship or trusteeship order. The court must be satisfied that: • the adult lacks capacity to make decisions about personal and/or property matters; • the order would be in the best interest of the adult; and • no less intrusive or less restrictive alternative(s) would be more appropriate for the adult and the situation.
