What happen in the case of Marbury v. Madison?
Lots of skuldrugery on this issue. One outgoing President, one incoming President. Neither one liking the other. Much ado about nothing really. But, the BIG mistake here was that the aggrieved party (Marbury) decided to take his 25 cent claim to the Supreme Court for adjudication (remember this point the next time you want to sue somebody) As it turned out, the issues MOST important to Marbury never did get adjudicated (he never got his commission) The Chief Justice of the Surpreme Court (Marshall) found the whole thing quite offensive to his liking and took it upon himself to impose, (for the first time) the power of the Court given him (as he saw it) to intrepret the laws of the land. Adams (outgoing president) had made appointments to fill various government positions before his term of office had expired. He used the current law (passed by the Congress) to do this.
