But, the BIG mistake here was that the aggrieved party (Marbury) decided to take his 25 cent claim to the Supreme Court for adjudication (remember this point the next time you want to sue somebody) As it turned out, the issues MOST important to Marbury never did get adjudicated (he never got his commission) The Chief Justice of the Surpreme Court (Marshall) found the whole thing quite offensive to his liking and took it upon himself to impose, (for the first time) the power of the Court given him (as he saw it) to intrepret the laws of the land.
