What gaming machines will be allowed in pubs?
Where a Premises Licence under the Licensing Act 2003 authorises the sale or supply of alcohol for consumption on the premises then the licence holder may apply to the Licensing Authority for a Licensed Premises Gaming Machine Permit. It should be noted that the Act will provide such alcohol-licensed premises with an automatic entitlement for up to two gaming machines (Category C or Category D) for use at the premises as long as written notification and a fee is provided to the relevant Licensing Authority, and that the provisions of any relevant Commission Code of Practice are complied with. However, the Licensing Authority can make an order to remove this automatic entitlement for reasons specified in the Act (e.g. if would not be reasonably consistent with the Licensing Objectives or if an offence under the Gambling Act 2005 has been committed). If a licensed premises wishes to make more than two gaming machines available, then under the new Act an application must be made to the Li
