WHAT FACTORS DOES THE ACCC TAKE INTO ACCOUNT?
The ACCC will consider a range of issues in determining the appropriate response to an allegation of price exploitation. In making a decision whether or not to pursue an investigation it will take into account a series of factors including the following: blatant disregard of the law; significant public detriment; educative or deterrent effect; and achieving redress for those adversely affected.
