What Dog Control measures have the Council taken and what additional steps are proposed for Dog Fouling and Dog exclusion from play and recreational areas?
The Council used its powers under The Dog (Fouling of Land) Act 1996 to introduce orders designating its recreational land and all carriageways (including footways and verges) within a 40 miles per hour speed restriction or less to be covered by this legislation as well as designated footpaths. If a person in charge of a dog does not clear up immediately after the dog has fouled on designated land, he or she has committed an offence. . The Penalty for this offence is a £50 fixed penalty notice, which must be paid within 14 calendar days of receiving the notice. Failing to pay within that period will make the offender liable to be summoned to appear before a Magistrates’ Court, where the Magistrates may impose a Level 3 fine (currently a maximum of £1000) The Council is permitted to continue with these arrangements until such time as the Council wishes to vary these arrangements.
