The U.S. Code, TITLE 17, article 506 states: “Any person who infringes a copyright willfully and for purposes of COMMERCIAL advantage or private FINANCIAL gain shall be punished as proven in section 2319 of title 18.” This means again, a violation is made when a profit or commercial gain is made.
