The Contract Act applies to most types of residential settings not licensed as nursing homes that: (1) primarily serve persons age 55 and older; and (2) arrange or directly provide two or more supportive services or any health-related services to residents. Supportive services are defined in the Contract Act as: • help with personal laundry; • handling or assisting with personal funds of residents; or • arranging for medical services, health-related services, social services, or transportation to medical or social services appointments. Health-related services include: • professional nursing services; • home health aide and home care aide tasks performed by unlicensed staff (as defined in the Minnesota home care rules); and • the central storage of medications for residents.
