Costs on a civil appeal determined by the Appellate Division are $250 (CPLR 8203[a]). A party who prevails on an appeal is generally awarded costs. A party to whom an award of costs is made is also entitled to tax his or her disbursements (see CPLR 8301[a]). Costs and disbursements are taxed in the office of the Clerk of the Court of original instance, not in the Appellate Division.
