What does RLUIPA make illegal?
RLUIPA is a law passed by the Federal Government that, in part, makes it illegal to unreasonably discriminate against religious institutions[1]. RLUIPA makes certain zoning practices illegal under the following provisions: Substantial Burden Provision. When making an individualized assessment, a governmental entity cannot “substantially burden[2]” a religious institution unless it (A) is in furtherance of a compelling governmental interest; and (B) is the least restrictive means of furthering that compelling governmental interest.[3] Equal Terms Provision. Imposing or implementing a land use regulation in a manner that treats a religious assembly or institution on less than equal terms with a nonreligious assembly or institution.[4] Exclusion Provision.
