What does Repeat Offender Court mean?
If a person has a certain number of previous felony convictions, a new arrest may result in their case being placed in what is often called Repeat Offender Court division (also known as “R.O.C. court”). A person may be deemed a “habitual felony offender” (sometimes stated as “R.O.C. eligible”) if he/she has previously been convicted of two or more felony offenses within five (5) years of the new arrest. It is important to note that other circumstances exist that can also apply that may or may not qualify someone as being R.O.C. eligible. If you have previous felony convictions, it is very important to consult with experienced and knowledgeable counsel to discuss your specific criminal history, any new charges, and a possible qualification as a habitual felony offender. These above-mentioned conditions are found in Florida Statute 775.084 and 775.08401.
