The Crown, home-educators, independent and Catholic schools have a common law duty to the students in their schools. The duty requires the Crown, independent and Catholic schools as well as employers where students are placed while on workplace learning programs, to take reasonable care to avoid exposing the students to any reasonably foreseeable risk of injury. The duty cannot be delegated.
