WHAT DOES ACTUAL PHYSICAL CONTROL MEAN?
State v. Zaragosa, 209 P.3d 629 (2009) is the most recent Arizona case to address the issue of actual physical control. Zaragosa states that in determining whether the defendant was in actual physical control of a vehicle, a jury should consider the totality of the circumstances shown by the evidence and whether the defendant’s current or imminent control of the vehicle presented a real danger to himself or herself or others that the alleged time.
