What does a Privacy Notice have to contain?
A. Much of the content of the Privacy Notice is mandated by HIPAA regulations. Basically, the Notice must advise individuals of their HIPAA rights and how they can enforce them, describe the plan’s duties with respect to HIPAA, and include a number of examples of how an individual’s PHI can be used or disclosed. Most importantly, the Notice must identify the plan’s “privacy official” and how that person can be reached, and identify a “contact person or office” who can be reached when the individual wants to exercise HIPAA rights.
