What documents may the employer accept as proof of identity and of work authorization?
There is a list of documents that is quite extensive that is included in the instructions to Form I-9 CNMI titled “List of Acceptable Documents.” We will not list them here. Note, however, that the employer may only accept original documents and the documents must be current, not expired. Are there documents specific to the CNMI that can be used even if they are not listed? Yes. Currently, documents sufficient to prove both identity and work authorization in the CNMI include: -Foreign unexpired passport and CNMI Alien Entry (red band on top) permit issued prior to 11/28/09; -Foreign unexpired passport and CNMI Permanent Resident Card; -Foreign unexpired passport and temporary work authorization issued prior to 11/28/09 and not yet expired. Note that these provisions leave several questions unanswered, such as the validity of an Umbrella Permit and what is the validity of a CNMI Entry Permit (blue band on top) as a qualifying CNMI document.
