What do the new information exchange provisions mean and when did they commence?
Under Chapter 16A in the Children and Young Persons (Care and Protection) Act 1998 you no longer require the consent of parents, carers, children or young people to exchange information about the safety, welfare or wellbeing of a child or young person. However, it is best practice to inform families that their personal information may be or is being provided to other agencies/organisations. Clients can still access their information through the Freedom of Information process. The new information exchange legislation commenced on 30 October 2009.
