WHAT DO EMPLOYEES HAVE TO DO TO TAKE ACCRUED SICK DAYS?
Employees would have to make reasonable efforts to schedule their sick leave so that it wouldn’t disrupt the employer’s operations. If they can’t do that (a child wakes up in the morning with a fever and the parent doesn’t know until the last minute that he or she can’t make it to work that day), they still have to notify the employer that they need to use sick leave. And if the leave is foreseeable (i.e. scheduled surgery or doctors’ appointments), the employee has to give the employer at least 7 days advance notice. Employers may offer their part-time workers additional hours in lieu of paid sick leave, and the employee has an obligation to accept these make-up hours as long as they don’t cause undue hardship (by conflicting with the employee’s other employment, childcare, educational classes, etc.
