Section 194J is for deducting tax from payments made FOR PROFESSIONAL AND TECHNICAL SERVICES. Even though you are working on a contract, your P&AO has rightly deducted 10% tax on payments made to professionals for technical or professional service rendered. Everyone is aware that there is no profession tax in the NCRT of Delhi. One way of checking whether they have filed the returns properly is go to form 26AS which gives deductions made by Govt. offices too under 194J. If the credit is visible in form 26AS, then you have nothing to worry. If it does not show therein, you have to approach the P & AO and request them to issue a correction statement showing your PAN. Unless this is done, the ITO is unlikely to give you credit for the tax deducted. It is of course deplorable that Government Offices do not follow the instructions of Income Tax Department and put tax payers to difficulties. But all is not over.
